Research shows the cost to recruit and train a new employee is around 20% of their annual salary, so if someone earning £35,000 resigns, you could spend around £7,000 organising their replacement!

Buying Through Your Business

Stamp Duty Land Tax
From a Stamp Duty Land Tax (SDLT) perspective, in the vast majority of cases, SDLT does not apply to caravans and mobile homes if they can be moved from place to place without being demolished/dismantled or damaging the fabric of the land on which they are sat. The majority of our lodges would fall into this category as they can be moved without being taken apart and without damaging the land. SDLT is however a highly specialist area so you may wish to speak to your accountant for separate advice on this point. For more information, please visit the HMRC manual.

Running Costs
If a lodge is bought through a company, then 100% of the running costs can be claimed as an allowable deduction (subject to the tax treatment of those employees or directors who use the lodge).

Taxation
If a company buys a lodge which is available for the sole use of a director or a member of their family, then a benefit in kind would arise on the provision of the free accommodation. Under normal circumstances, unless it is let or the company is actively trying to let the property when it is not in use by the director, then a benefit in kind will arise, not just based on the number of weeks the property is occupied but on the basis that the property is available for use by the director for 52 weeks of the year. The director would pay tax at their highest marginal rate and the company would pay Class 1A national insurance on the benefit as well.

If however the lodge is available for use by all of the company employees (and actually used by the employees) the benefit in kind is normally calculated based on the actual use by the director or employee i.e. if an employee is allowed to use the property for one week a year, then they will pay tax on the provision of this benefit at their highest marginal rate.

The tax due on any benefit in kind is paid by the employee in question i.e. in effect, they pay tax on the free accommodation or holiday. In certain situations however, a company can enter into a Pay As You Earn Settlement Agreement with HMRC to effectively pay the tax due on any employees benefits. This only applies however in certain situations where benefits are irregular and not contractual but the “use of a company’s holiday flat” is given as an example in the HMRC guidance. This may therefore be a possibility if a week’s free accommodation is given to employees on an ad hoc basis as part of an incentive arrangement put in place by the employer.

Of course, it is worth discussing the best options to suit your business with your accountant, the above is a general guideline is not specific legal advice.
